Terms of Use

These Terms of Use (“Terms”) are an agreement between you and [LEGAL ENTITY], which publishes games on Google Play as [DEVELOPER NAME] (“we”, “us”, “our”), the developer of Color by Number (the “Game”, Android package com.villain.colorbynumber). By installing, accessing or playing the Game you accept these Terms. If you do not accept them, do not use the Game.

1. Who may play

  • You must be at least 13 years old, or the minimum age required in your country.
  • If you are under 18 (or under the age of majority where you live), a parent or legal guardian must review and accept these Terms for you.
  • You may not use the Game if the law of your country does not allow it.

2. Your licence to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment.

The Game and everything in it are owned by us or our licensors and are protected by copyright and other laws. This includes code, pictures and line art, artist collections, stories, graphics, music, sounds, text and virtual items. All rights not expressly granted to you are reserved.

3. Pictures you color

You may save the pictures you color in the Game and share them with friends and on social media for personal, non-commercial purposes. The original pictures and line art remain ours or our licensors’. You may not sell your colored pictures, use them in products or advertising, or present the original artwork as your own.

4. Gems, hints and Premium

The Game is free to play. You earn gems and hints by playing, for example by finishing pictures, daily rewards or optional rewarded ads, and spend them in the Game, for example on hints or to unlock pictures. You can also buy a Premium subscription with real money.

  • Premium. Weekly, monthly and yearly plans are available. Premium removes interstitial and native ads, gives unlimited hints and daily gems, unlocks pictures that otherwise need a video, and removes the watermark from shared pictures. The benefits shown in the Game when you subscribe apply for as long as your subscription is active.
  • Purchases go through Google Play. Payments, billing and refunds are handled by Google Play under its terms. Prices are shown in the Game in your local currency as provided by Google Play, and may include taxes.
  • Automatic renewal. A subscription renews automatically at the same price and for the same period until you cancel it. You can cancel at any time in Google Play (Play Store › Payments & subscriptions › Subscriptions); you keep Premium until the end of the period you have paid for. Uninstalling the Game does not cancel a subscription.
  • Restoring. Premium is linked to your Google account and comes back when you open the Game on a device signed in to the same account.
  • All sales are final except where Google Play’s refund policy or the law requires otherwise, including your rights under the consumer laws of your country.
  • A licence, not property. Gems, hints, unlocked pictures and other virtual items give you a limited licence to use them in the Game. They have no value outside the Game, cannot be exchanged for real money or goods, and cannot be sold or transferred to anyone else.
  • Changes. We may change, re-balance or stop offering virtual items, their prices in gems, and Premium plans and benefits. A change to the price of your subscription applies only as Google Play allows, with notice.

5. Your progress

Your pictures, progress, gems and hints are stored on your device. If you uninstall the Game, clear its data, or lose or change your device, this progress may be lost, and we cannot restore it. An active Premium subscription can be restored as described above.

6. Ads

The Game shows ads from third parties, including full-screen ads, a native ad at the bottom of the coloring screen, and optional rewarded ads. We are not responsible for the content of third-party ads or for products and services they offer. How ads use your data is explained in our Privacy Policy.

7. Pictures and internet access

New pictures are downloaded from our servers, so an internet connection is needed to open pictures you have not started yet. We may add, change or remove pictures, collections and stories at any time; pictures you have already started stay on your device.

8. Fair play

You agree not to:

  • cheat, use bots, hacks, modified versions of the Game or any software that alters how the Game works;
  • exploit bugs or errors to gain items or progress; please report them to us instead;
  • copy, extract, reverse engineer, decompile, modify or distribute the Game or its content (including its pictures), except where the law allows it;
  • use the Game for any commercial purpose or in any unlawful way.

If you break these rules we may end your licence to play.

9. Changes and availability

We may update, change, suspend or stop the Game or any part of it at any time, for example to add content, fix problems or meet legal requirements. Some updates may be required to keep playing. We do not guarantee that the Game will always be available, uninterrupted or error-free.

10. Third-party services

The Game is distributed through Google Play, and its ads come from Google AdMob and its partners. Your use of these services is also subject to their own terms and policies, and we are not responsible for them.

11. Privacy

Our Privacy Policy explains how we handle information when you play. It is part of these Terms.

12. Disclaimer

The Game is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms excludes or limits any rights you have under consumer protection laws that cannot be excluded.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, progress or virtual items. Some countries do not allow these limits, so they may not apply to you.

14. Ending these Terms

You can stop using the Game at any time by uninstalling it. We may end your licence if you break these Terms or if we stop offering the Game. Sections 2 (ownership), 3 (pictures you color), 4 (the nature of virtual items), 12, 13, 15 and 16 continue to apply after these Terms end.

15. Governing law

These Terms are governed by the laws of [COUNTRY]. The courts of [COUNTRY] have jurisdiction over any dispute, unless the consumer laws of your country give you the right to bring a claim where you live.

16. General

  • Changes to these Terms. We may update these Terms. The new version is posted on this page with a new “Last updated” date. If you keep playing after a change, you accept the new Terms.
  • Severability. If any part of these Terms is found invalid, the rest stays in effect.
  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Game.
